The regulation that requires it in New York
Federal OSHA requires a written fall protection plan when conventional fall protection is infeasible for leading edge work under 29 CFR 1926.501(b)(2)(i) Exception and 29 CFR 1926.502(k). New York follows federal OSHA rules with no approved state plan for private employers; public sector enforcement is handled by PESH.
Enforcing agency
Federal OSHA — Region II (public sector covered by PESH) inspects private employers in New York. The agency issues citations under federal standards and coordinates with PESH for public sector workplaces. PESH adopts and enforces equivalent standards for state and local government employers.
