The regulation that requires it in New York
New York follows federal OSHA rules for hazard communication. The document is mandated by 29 CFR 1926.59 / 1910.1200, which requires a written hazard communication program, SDS library, and employee training. New York does not run an approved state plan for private employers and follows federal OSHA.
Enforcing agency
Federal OSHA — Region II (public sector covered by PESH) is the enforcing agency. They inspect private sector employers and public sector employers through PESH. They have citation authority under federal rules and coordinate with federal OSHA on enforcement matters.
