The regulation that requires it in California

California Labor Code Section 6401.9 (SB 553) mandates a Workplace Violence Prevention Plan for every employer in the state. California operates an approved state plan under Cal/OSHA.

Enforcing agency

Cal/OSHA (Division of Occupational Safety and Health) enforces the rule. They inspect California workplaces for compliance. They coordinate with federal OSHA as needed.

Penalties for non-compliance in California

How to comply

  • Customize the plan for your specific workplace hazards
  • Train all workers on the plan and their responsibilities
  • Maintain a violent incident log and review it regularly
  • Review and update the plan annually or after incidents
  • Post required notices and make the plan available to employees
