Workplace Violence Prevention Plan
Required for every CA employer July 1 2024. Covers all four violence types, incident log, training.
What this document is
This document is a written Workplace Violence Prevention Plan required under California law. It identifies hazards, sets response procedures, maintains an incident log, and outlines employee training for the four types of workplace violence.
The regulation that requires it
CA Labor Code §6401.9 (SB 553) requires every California employer to establish, implement, and maintain an effective workplace violence prevention plan. The law states that the plan must include names of persons responsible for implementation, procedures to identify and evaluate workplace violence hazards, and methods to correct them. It also mandates training, an incident log, and recordkeeping. The regulation took effect July 1 2024 and applies to nearly all employers in the state.
Who needs it
Every employer in California with one or more employees needs this plan. California contractors in every trade including general contractors, electrical, plumbing, HVAC, roofing, and site work must comply. The requirement comes from state law under Cal/OSHA authority and does not apply outside California.
What happens without it
Cal/OSHA can issue citations during inspections for lack of a required written plan. Serious violations currently carry penalties up to $18,475 per violation while willful or repeat violations can reach $145,027. Contractors face higher inspection risk on multi-employer worksites where citations may be issued to both the controlling employer and subcontractors.
